Game Condition Comments: Arizona elk are managed well and there were many big bulls. We saw a 370, looked for another 370 class before I took a 397 bull on day three. Literally saw hundreds of elk.

Problems of Hunt:
Highlights of Hunt: This is a hunt I had been waiting for for a long time. I had my sights set on a 350 plus bull. I had hunted w/Rincon previously taking a #8 javalina, 100+ inch Coues deer, mule deer, and previous elk. They know the country very well and have decades of experience getting big elk. We spotted my bull while watching a 370 class bull we couldn't get to. We found my elk three times over two days as he traveled a few miles from where we originally spotted him. The great burn in the area a couple years ago has opened up visibility a lot. In spite of having broken off a point and main beam on the right antler the bull still scored 396 5/8. He was around 420 before the break. A truly tremendous trophy. He was an 8x8 but is now a 7x8 w/tremendous mass.

Why? Experience and glassing ability. Rom and his guides took four bulls that hunt in four days all in the mid 300s or bigger.

I was told the person w/the governor's tag was looking for this bull. Rincon has an exceptional amount of experience in this area along with contacts w/locals to know where and when the big bulls are. There are many elk and big bulls here and it was worth the ten year wait for the tag. There is some serious hiking involved as the really big elk do not hang out in easy country.

Problems of Hunt:
Highlights of Hunt: Hunting in Southern Arizona in a saguaro forest is a neat experience. Shooting a magnificent buck (105") with a 5" drop tine.
Equipment Recommendations: Long range rifle, and be able to shoot 3-600 yards. Binoculars with Tripod. I had 10x42 Swarovski EL and wished I had 15X. I did take a spotting scope despite my outfitter telling me it wasn't needed. It came into use and I would take again.

Why? The guide knew his stuff, He knew the country, where the deer would hold, how they would react, how to judge the size of trophy.

Highlights of Hunt: After 4 days of non-stop glassing and hiking, Jim finally spotted the deer getting up from under a mesquite tree. He glassed that area for a few hours and saw nothing. Amazing how the deer appeared out of no where. Guess that's why they are called the "grey ghost of the desert"
Equipment Recommendations: minimum 15 power binos and good hiking boots

Why? Rincon Outfitters has good areas for Coues. The owner, Rom Dryden, knows the business and has excellent guides who know how to scout. It's very difficult to pick these animals out in a desert background, but these guys know how to find them. Rom has areas that aren't so difficult to hunt with camp facilities, but I stayed in a spike camp and roughed it out for a few days in hopes of seeing a trophy deer. If you don't mind roughing it, this is the place

Why? If you can draw the tag, Rom and his team will do everything to get your animal. Both of us in camp filled our tags with old mature bulls.

SUMMARY REMARKS
Problems of Hunt: No problems. This is a rough-it camping hunt with lots of spot and stalk and long hikes. That's what's necessary to get these little guys. Long shots too.
Highlights of Hunt: Getting my first Coues Deer and following up with the predator hunt. Seeing a pack of Coati and the mountain lions.
Equipment Recommendations: Good boots; good long-shooting rifle with scope. Gaters for those stick cactus spines!
Would You Recommend This Hunt to a Friend? yes
Why? It's the real deal for a Coues and it's in the USA. Be prepared for a rugged hunt -- no frills here.

This hunt was a trophy desert mule deer hunt in Unit 35A which is a draw hunt. The hunt is a muzzleloader hunt. During the hunt we did not see any trophy mule deer. My discussions with the guides and ranchers indicated that this was unusual. The outfitter has top SCI entries from this area in recent years. The problems with this hunt reflect a lack of judgment and maturity of the outfitter, Rom Dryden. Rom Dryden is a good hunter with a lot of experience; however, he certainly did not qualify as a good outfitter on our hunt. Mr. Dryden had dismissed his regular cook and brought in a woman who was a past acquaintance to do the cooking. This lady was fresh from the hospital recovering from a beating given by her boyfriend. She had no experience whatsoever and appeared to be impaired with drugs and/or alcohol. Her mind was short-circuited and she could not carry on a conversation, however, she was successful at being a total nuisance. The conditions of the kitchen were deplorable and unsanitary to the extreme with dirty dishes and food left everywhere. Mr. Dryden made no effort to correct the situation. Mr. Dryden finally left with the helpless woman and did not return although he was supposed to return with food. We were reduced to eating soup the last evening. The guides apologized profusely for the camp and the bad feelings generated by Mr. Dryden

To: Ivan Schell From: Duane L. Shroufe of Game and Fish Department Re: Hunt in Arizona Date: December 13, 2000

The Arizona Game and Fish Department has reviewed your letter dated November 16, 2000 concerning an incident on November 13, 2000, in which you shot a deer that was subsequently shot and retrieved by another hunter. The Department also reviewed a letter from David Eppihimer corroborating your account of the incident.

At approximately 10:00 a.m. on November 13, Department Officer Robert Fink entered the Rincon Outfitter Inc. camp while on routine patrol and became aware of the incident through your account. At approximately 12:00 p.m., after witnessing Ken Baldauf and his partner traveling to their camp with the deer in question. Officer Fink interviewed the hunter and checked the deer.

The account of the incident provided to Officer Fink by the Baldauf camp was very similar to that provided by you, including your description of three bucks and the long distance at which you were shooting at the deer. However, the Baldauf camp, claimed not to know at which deer you were shooting, and they did not concur with your statement that the deer was "lying flat on the ground with its head slightly raised."

The deer at the Baldauf camp, checked by Officer Fink, had two apparent bullet wounds. The first was to the front left leg, approximately one-half of the distance up the leg from the hoof. The second was to the chest, behind the front shoulder. Both bullets exited the deer and were not recovered.

While both parties now agree that you likely hit the deer, based on the statements by both parties the deer was not killed by you and was never reduced to your possession, and therefore could not be stolen. Mr. Baldauf's involvement in the incident appears to be limited to being present, for he was neither guiding nor hunting.

Our investigation of the incident revealed no violation of state law, and therefore, no criminal complaints may be filed. Revocation of guiding or hunting privileges occurs under the authority of state law and requires that criminal charges be filed and the alleged individual allowed due process prior to any revocation hearings. There is no further action we can take against any individual given current legal constraints. We consider this case closed at this time, unless additional information can be provided to substantiate criminal charges against any subject individual.

The Department appreciates your concerns with this matter and your willingness to report the incident. Thanks for your e-mail about the Arizona hunting trip. I am forwarding to you by US mail the response of the Arizona Fish and Game. As you will be able to see, the issue in fact comes to one of "he said-he said"

The shooting accident occurred when four of the hunters in camp decided to pursue a group of ringtails traveling up a ravine. Four hurters armed with shot guns and a rifle split up and hiked up opposite sides of the ravine. The hunter with the rifle stated that he thought he saw a ringtail in a tree on the opposite side of the ravine and took a shot at about a 50-yard distance. He hit another hunter in the abdomen with the .22-250. One of the hunters then raced to a local ranch house to call the air ambulance from Tucson. The injured hunter was at the hospital within about an hour after the incident. No organs were apparently hit and the injured hunter was released from the hospital after about a week. Interestingly there was no law enforcement investigation of the incident as far as I know. If you have additional questions please give me a call.

Thank you very much for your inquiry into Mr. Schell's experience in Arizona. I appreciate Mr. Schell's sharing his disappointment with you, but I am a little disappointed he did not share his concerns with me. I have never seen as unprofessional behavior as exhibited by Anderson Guide Service's guide that day in Arizona. Not only was he trespassing, but he shot a deer that was "obviously' down and belonging to Mr. Schell. I am also very disappointed in our Game & Fish Department for not properly handling the matter as there was several game violations made by Mr. Baldoff (Anderson Guide Service) during the incident.

I will briefly comment on Mr. Schell's estimation as to trophy quality in the area. Mr. Schell only hunted two-and-a-half days of what was to be a four-day hunt. As we all know, Coues deer can be very difficult and a little over two days of hunting can not qualify an opinion of trophy quality.

In 2000, we harvested fifteen Coues deer eight-point or better. We placed our third buck into SCI's Top Ten (Archery #7), and only three hunters failed to harvest a buck. On our October hunt, all the hunters shot 90 or better deer in the first three days of the hunt and in December, our four hunters all shot big, mature bucks on the first day! One hunter saw 25 bucks and a total of 175 deer in one day. (Jason Jensen w/Fred Mau Outdoor Adventures). These were all in the same camp that Ivan visited. To see 175 Coues deer anywhere in the world is an achievement and a testament to the quality of the hunting area. When a hunter is not willing to hunt the entire hunt, I cannot take responsibility for his success or lack there of.

I will briefly comment on the hunting accident: Due to pending litigation between the two hunters, I cannot comment on any specifics of the incident. I will tell you the hunters were hunting on their own, without guides, near the camp during the daily lunch hour in camp. Mr. Schell claims the situation was "foreseeable" by the outfitter and should have been avoided. I disagree with Mr. Schell's opinion, as he was not present at the time, and the victim would also disagree with Mr. Schell. The victim has rebooked and is eagerly looking forward to his next Arizona hunt.

I am writing to report an incident that I witnessed on November 13, 2000 in unit 33, hunt #1094. As the holder of an antlered whitetail deer tag, I hired an outfitter to guide me on a deer hunt in unit 33. This was the fifth time that I have purchased a hunting license in Arizona over the past several years, but the first time that I have hunted in unit 33.

On the third day of the hunt (11/13/2000), my guide and I spotted three legal bucks at a distance of about 500 yards. Also spotting the deer was Ken Baldoff, apparently a licensed guide in Arizona (working for Anderson Guide Service in Tucson) who was accompanying his female companion on her hunt. My guide, Josh from Rincon Outfitters, Inc., approached Mr. Baldoff and suggested that we set up together to shoot simultaneously at two of the deer. Mr. Baldoff declined and stated that they would move down the ridge and wait to see if the deer moved off toward them after I attempted to harvest a deer.

I then set up and began shooting at the deer. Because the distance was long, it took several shots to get the range but I was able to then shoot and mortally wound the deer. I was then advised by the guide that Baldoff was approaching the deer that I was shooting and in fact, I then spotted him about 75 yards from the deer, between the deer and me. I was then of course unable to continue any shooting. Baldoff located the deer, which was lying flat on the ground with its head slightly raised and directed his female companion to shoot. The female companion then shot the deer. After congratulating her on the shot, he took her tag and put it on the deer.

Both my guide and I were stunned. Also witnessing the event was David Eppihimer of Tucson and another holder of an antlered whitetail tag. In addition to demonstrating incredible stupidity by walking into my line of fire, Baldoff stole the deer that I had harvested. It is clear from his actions that his intent from the beginning was to steal the deer. Rather than precipitate a possibly of violent confrontation over a deer, we backed off and reported the incident to Arizona Game Warden, Bob Fink. Warden Fink allowed that the incident was incredibly unethical but declined to do anything about it. It is also likely that Baldoff crossed private land without permission in order to access the area being hunted.

The purpose of my writing is to ask that you order an investigation into this unethical and possibly illegal incident and take appropriate disciplinary action against Mr. Baldoff, up to and including the termination of his guiding credentials.

My name is Brian Peterson, and I am a master guide in Alaska. In 1998 I hunted with Rincon Outfitters for Coues deer in Arizona. It was an excellent trip and the quality and quantity of the deer I saw was all anyone could hope for with a fair chase hunt. I plan to hunt with Rincon again and would strongly recommend anyone else to do the same. On my hunt I took a 100-class buck and saw at least 4 other bucks that were larger with one around 110-115. The camp, food and guides were excellent. A very professional, well-run and hard hunting organization. It is interesting that a client would complain about an outfitter in the context of other hunter's behavior in an area on a public land hunt. The outfitter obviously has no control over such circumstances or behavior. During my experience with Rincon we saw other hunters in the field yet had an enjoyable and rewarding experience. The hunting accident you mentioned in your report was an example of poor judgment on behalf of an unguided hunter. It is not right that it was mentioned at all let alone with an implication of possible criminal charges. I doubt that it had anything to do with Mr. Schell's hunt and I hope this is brought out in the detailed report and correspondence that followed. Normally on controversies you have well balanced sides of the story but this one seems to be a bit one sided. The outfitters view should not be considered incidental.
