ADDITIONAL HUNTER COMMENTS AND/OR OUTFITTER/BOOKING AGENT REBUTTAL
My name is Dean Inmon and I am one of the hunters that went on a safari with Mitch Cain and Out of Africa safaris. This whole experience with this company and Dawie Groenewald is a Joke! I have made every attempt to get things straightened out with everybody, and have gotten nowhere. Dawie is full of broken promises; he tells you what you want to hear so you will leave him alone. I'm not a rich man and I don't know if I will ever be able to afford another hunt like this - for me this was a hunt of a lifetime.

I have paid him in full years ago. He still has three of my trophies that I do not have. I am tired of pleading with this man. He should not be able to get away with this. I hope you can do something on my behalf. Dawie claims that one of the hunters still owes him money! Here are just a few facts: We are all individuals that booked a hunt with Out of Africa. We all paid separately, even though we know each other - that shouldn't mean anything. The other parties in the group tried to pay all monies that were owed (one hunter debt) at last years SCI show so that we could get our trophies released-balance of trophies being held for ransom! All this items from Zimbabwe.

All I know is that I still do not have all my trophies from Zimbabwe. I have proof that I have paid for everything - everything. I am tired of Dawie's lies and broken promises. I can get you copies of all conversations (e-mails) with Dawie, and I have all receipts proving I've paid him in full.

I just want my trophies that I have paid for and that he has promised me. At this point I'll even settle for a refund for that portion of the hunt plus trophies fees. I really want my trophies.

Copy of email correspondence:

From: Matabeland Taxidermist To: Mr. Penn

I hope this email finds you well. Please be advised that we have been contacted by Headman Sibanda, who wished to come and collect trophies for the hunting party listed below. The only trophies that will remain with us are those logged in under the name of Mitch Cain, as we have been instructed not to release them.

Please would you kindly urgently check the list of trophies and via return email send through confirmation of all the hunters and what trophies belong to them, in order for us to ensure that we release the correct to Headman.

Your urgent assistance would be greatly appreciated.

From: Matabeleland Taxidermist To: Mr. Penn

Please receive list of trophies that we currently have logged in under the party that came hunting.

Delivered for the group by Trends Tours on 12.06.06 2 x buffalo cape / horns 1 x kudu cape / horns 1 x buffalo fullskin / horns 1 x sable cape / horns / backskin

Please be advised that we are able to release these trophies to Headman Sibanda, should you want us to do so. To date, there is no export documentation to cover any of the above trophies. Mitch was hoping to resolve all discrepancies with Headman in Reno. All of the trophies are safe with us. If you do not mind my asking, why do you want to release these trophies to Headman?

From: William Penn To: Matabeleland Taxidermist

Dear Dawn,

My name is William Penn and I was a member of the safari with Out of Africa Adventure Safaris that you are discussing with Mitch Cain. My trophies, a Cape buffalo, a sable, a giraffe and a hyena are in your shop. Dawie of OOAAS has asked me to authorize the release of these trophies to Headman Sibanda, which I am doing now. Is the required paperwork in order on these trophies and are you able to release them to Headman? Please let me know the circumstances as soon as possible as I have been waiting two and a half years for my trophies.

From: Out of Africa To: Dean Immon

Dean,

It must be all the trophies because Ernest was paid in full. Very difficult for me can't get through to Zimbabwe by telephone, Headman was hunting didn't talk to him in 4 weeks, will follow up.

From: Dean Inmon To: Out of Africa

Dawie, is this just the items that Headman picked up? What about the items Ernest has? My kudu was under Ernest at Malindi. All of my trophies include my kudu, warthog, sable and backskins, tusks and skull. Please let me know if all my items will be included on these export papers?

From: Out of Africa To: Dean Inmon

Dean,

I gave all the information to Headman from Nyala Safaris. I am waiting for him to send me the export papers, as soon as I get them I will forward it to you.

From: Dean Inmon To: Out of Africa

Dawie, it's been many months since I've had any correspondence with you regarding out trophies from Zimbabwe. At last email Headman Sibanda was authorized to pick our trophies from Matabeleland for shipment to the US. I've heard nothing since then? The SCI show is going to be here again in January 2009.

In January 2008 when we were all present at your booth, you assured all of us (Bill Penn, Bill & Tom Dejong and Dean Inmon) that we would receive all of our trophies.

It's been almost a year now since the show and still no trophies.

What's the deal? I want my trophies that I have paid you for. You've promised me time and time again and nothing. It has been many years since we were on your hunt in Africa - you have been paid in full from me. I have done everything you have required me to do and still nothing. Ethically and morally you owe me what I have paid you for and what you promised me you would do by sending me my trophies.

From: Mitch To: Dean

Hey Dean,

Did you call Dawie again? I don't know what to do at this time. I guess wait and see as usual.

Mitch

From: Esibanda To: Mitch Cain

Hi Mitch please be advised that what you owe me is for animals which were harvested by you and your companion hunters at Malindi, these include:

Sable x 2 USD $6,000 Baboon x 2 USD $30 Giraffe x 1 USD $1,500 Buffalo x 1 USA $2,500

The other money is for the days spent at our camp and the government levy 2% the cost of the days you spent with us. Your total bill for Malindi was USD 16112. Dawie has paid USA 8,112 and he says you should pay USD $8,000. I have added USD $300 for transporting the trophies from Malindi to Taxidermy so you are required to pay total of USD $8,300.

You can wire the money to: KMB Bank

Note that we have resolved to have no further communication on this matter on 31 December 2006 and shall at this date withdraw trophies from the taxidermy if payment is not made.

From: Mitch Cain To: Ernest Sibanda

I really appreciate what you have done for us, but my clients are just not willing to pay for only those trophies. They and I were told by Dawie that if we paid you the $8,300 we would receive all of the trophies, not just this small amount of trophies.

I just really don't know what to do at this point. They all feel that Headman is not their responsibility and they don't want to pay him. Nobody likes to be extorted. They and I have already paid Dawie over $80,000 USD and they don't want to pay any more except what Dawie said I owe you. I am sorry.

If Headman were to release all the paperwork for all of the trophies involved then we would surely pay you, but if he won't then I don't know what to do.

Let me know if you have any ideas.

Thank you and have a Merry Christmas

From: Ernest Sibanda To: Mitch Cain

Reference is made to our last email. We advised that the $8,300 USD you owe us is for the following animals.

2 sable 1 hyena 1 buffalo 1 baboon 1 giraffe

Including the number of days you spent at our place.

You are further advised that the payment of amount will not enable you to receive all of your trophies but only for those indicated above.

Hope I have played my past as I do not have authority over Nyala Safaris trophies.

From: Nyala Safaris To: Mitch Cain

From our records we believe that you are making payments for your hunted trophies through Trends and Tours Safaris, however we would like to draw your attention to the following animals which were harvested by your companion hunters and yourself.

Client Animal Harvested Cost Farm Bill Penn 2 sable $6,000 Marara Dean Immon Warthog $200 Marara Tom Dejong sable $3,000 Marara Mitch Cain buffalo $2,500 Kana Lot 8 Total $11,800

These monies are now due and payable before the release of the trophies to Matabeleland Taxidermy.

Email from Mitch

Hey Guys:

Maybe you guys can go and talk to Headman Sibanda about this. Because I won't be going to SCI this year.

Thanks Mitch

From: Headman Sibanda To: Mitch Cain

I am sorry I had misplaced your email address therefore I could not contact you. I will be in the USA from 22 January to 3 February 2007 attending the Reno Show.

I would really appreciate it if we could meet and discuss about the outstanding trophies which were hunted in 2005. Check for me at booth number 603/604 Sondela/Inhlaba.

Headman Sibanda

From: Dean Inmon To: Cicilia

Here is a list of all the trophies that was taken by our group: my personal animals included 1 kudu-cape, horns and backskin / 1 sable-cape, horns and backskin / 1 warthog skull, teeth and cape. All the other animals included 4 buffalo, 4 sable, 1 crocodile, 1 giraffe, and 1 hyena. My customs broker is in Oregon, always customs. All trophies need to be received through them to receive proper clearance.

I can forward you all the pertinent information when you have gotten me a list of all the trophies and items ready for shipment

All these trophies were in care of Ernest and Headman Sibanda.

From: Nyala Safaris To: Dean Immon

I would really like to apologize for the delay that you had in receiving your trophies. I am new in office and I am busy clearing trophies that are outstanding. I went through the Mitch Cain group and I have noticed that your trophies were returned from Matabele Taxidermy. I am sorry if I am going to take you back and asking you questions that have been asked already but may I please have a full list of the trophies that you want exported so that I do not have any further complications. And please confirm your physical address. May I please have Mr. Mitch Cain's e-mail address.

From: Barbara Crown of The Hunting Report To: Out of Africa, Nyala Exports and Nyala Safaris

Dear Gentlemen,

I sent both of you an e-mail back in August 2008 regarding a complaint we received from Mr. Mitch Cain regarding a hunt he arranged for himself and some of his taxidermy clients through Out of Africa Adventurous Safaris for a safari to Zimbabwe. I never heard back from either of you, so I am trying one more time, as I have received a request from another member of Mr. Cain's party.

I understand that the safari was actually conducted by Headman Sibanda of Nyala Safaris and Ernest Sibanda of Trends Tours. The hunt took place in the Malindi area in 2005, but according to Mr. Cain, no one from his party has yet received their trophies. I understand Mr. Cain is withholding payment for his own trophies until his clients receive theirs. Several of the hunters from Mr. Cain's party also contacted us, saying that they had all paid their bills and have the receipts and invoices to prove it and would like you to send them their trophies.

Mr. Dean Inmon recently contacted me and sent me documentation as well as dozens of e-mail communications regarding the matter. I have included scanned copies of the items I think summarize the situation. They include Mr. Inmon's invoices showing his payment, as well as the copy of a check. They also include the e-mailed bills and lists sent to Mr. Cain for the party as a whole from both Nyala Safaris and Trends Tours, beginning in April 2006, a full five months after their safari and continuing until Mr. Headman Sibanda's e-mail of January 11, 2007, requesting that the hunters meet with him at the SCI convention to resolve the outstanding trophies. Further e-mails indicate things were resolved and the trophies were released from Matabeleland Taxidermist to Mr. Headman Sibanda who was supposed to get export paperwork completed and to Dawie Groenewald for final shipment. However, I have an e-mail from Cicilia at Nyala Exports to Dean Inmon asking for a list of trophies to ship.

Can one of you please tell me what the status of these shipments is so I can inform my subscribers (Mr. Cain and Mr. Inmon, and their friends) who have asked me to look into this situation for them. From Cicilia's e-mail it seems Nyala Exports (part of Nyala Safaris?) has the trophies. Have the export documents been secured now? Can someone explain why it has taken so long to get these trophies moving? Once the party members receive their trophies, if Mr. Cain sends his outstanding payment, how quickly can his paperwork be processed and his trophies send out? A response of some kind from you would be much appreciated.

Sincerely,

Barbara Crown Editor The Hunting Report

From: Out of Africa To: The Hunting Report

I already respond to you on another occasion on this same matter. But I will be more than happy to give you the info again.

The client Mitch Cain paid but his check bounced and they never got his money until now. They are keeping everybody's in Mitch Cains group trophies back because of this bounced check. I tried everything in my power to get the other people in Mitch group trophies out but they say no, because what kind of guarantee do they have if they send all the other clients trophies that they will get the money from Mitch Cain.

Mitch Cain needs to pay and then they will release everybody else in his group trophies.

From: The Hunting Report To: Nyala Safaris

Dear Cicilia,

I hope all is well with you. I am writing to follow up with Mr. Sibanda regarding the e-mail I sent him on May 14 regarding the trophy shipments for Mr. Inmon, Mr. Cain and the rest of their party. In you last communication on May 20, you indicated that Mr. Sibanda was out of town but due back the following week. Several weeks have now passed. Has he had a chance to see my e-mail and the items I sent in a PDF file? My subscribers would like to resolve this and get their trophies. Thank you for your attention to this matter.

From: Nyala Safaris To: The Hunting Report

Thank you for your email. Nyala Exports is the export company for Nyala Safaris.

When I got into the office I realized that the Mitch Cain group trophies had not been shipped in time. I was informed that there are payment issues to be settled. I however have been give a green light to process for Mr. Dean Inmon. Have made all the necessary application for his permit. Mr. Sibanda is not in town until next week. Then he will give me further instructions on the rest of the trophies. Your trophies that are with us are in good order, they have been cleaned packed and crated and they constantly get sprayed. I hope that my next week I will get further instructions as to the rest of the clients.

I am sorry I am not able to comment on other issues as only Mr. Sibanda is able to answer those.

Game Sought But Not Taken:
Game Condition Comments: This was my wife Michele and my first hunt in South Africa. We bought the hunt at the annual NRA Show for two hunters and two non-hunters. We went with some friends from Houston and had a great time. Dawie worked with us so that all four of us were able to hunt without a per day hunt fee. We all hunted with Tilly and his tracker Johanas and took turns on the stalk. We all had a great time. Tilly was fantastic getting on game and spent three hours talking a zebra for Michelle to take. He was very patient. He knew his area well and was an excellent judge of size. Tilly kept us laughing for five days. Dawie was a great host and his staff maintained a fantastic camp. The lodge and guest houses were both great. We took all the animals we were after in four and a half days of our 10 day hunt. We then decided to have Dawie set-up a tour of Kruger National Park for us. The first day was fun but after that we were a little bored. Elephant #1 looked much like elephant #7,349. We are hunters and do not get to the zoo much. The buffalo were impressive and provided several highlights. We would very much recommend Dawie and his Prachtig Ranch for a husband and wife hunt that had plenty of bush for good animals but was very comfortable for my wife. I am saving-up for a buffalo hunt with Tilly off the ranch and into the bush. We will be back.

SUMMARY REMARKS
Problems of Hunt:
Highlights of Hunt: Having my wife Michelle take some beautiful animals capped-off with her zebra hunt. I took a great blue wildebeest and made a good shot on a kudu from "the mountain".
Equipment Recommendations: Bring what they tell you to and do not forget your soft gun cases. Very nice accommodations.
Would You Recommend This Hunt to a Friend? Yes
Why? Tilly was great. Dawie's camp was fantastic. I see Dawie as an honest businessman that like to close "the deal" as much as we all do. The staff left you wanting for nothing. As this was our first hunt in South Africa I had a lot of questions for our booking agent, Teressa Groenewald - Dawie's sister-in-law, who was slow to respond taking several weeks to return a call or an email. She always did respond, it just took a while. So if you are a type A, just recalibrate your expectations and all will go well.

ADDITIONAL HUNTER COMMENTS AND/OR OUTFITTER/BOOKING AGENT REBUTTAL
Rebuttal from Out of Africa:

I will just answer this briefly for you,I am still hunting and will give you a full report from my lawyer at the end of November. As you know by that time I was acting as a agent and this people Mitch Cain booked the hunt through me and I send them to Zimbabwe to go and hunt,I was not personally on the hunt and all this accusations that this guy Mitch Cain is making is not true and all of this is because of his own making. They went to a camp with the name of Malindi that is on the border with Hwange National Park and they hunted with an outfitter with the name of Ernest Sibanda, they shot a lot of game on his property. Nothing went wrong on the hunt and it is always like that, that he will come after words 2 years with this sour grapes. When he finished the hunt and it was time to pay there is always a problem. I paid Mr Ernest Sibanda in full for all the game that is shot and Mr Mitch Cain cancelled his check when he got back home and the check didn't went through, I don't know if there was not money in the bank or he cancelled it. Now he is asking why he didn't get his trophies as simple as that he didn't pay for the trophies and the outfitter will not sent one of the trophies if he doesn't get his money. As for the poaching of animals and the snaring I don't know but if it was illegal what he is saying that is not true there was a Zimbabwe PH on every hunt. Mitch Cain left the country and he wrote a letter to Parks ask them to get his trophies out, so if he did not trust me or the outfitter then he must get his own trophies out. He just need to pay the outfitter the phone number of Ernest Sibanda is +263 11739919 in Zimbabwe that is his cell phone.

Additional comment from Out of Africa:

I called Ernest Sibanda and Headman Sibanda, the trophies is Matebeleland Taxidermist and with Headman Sibanda. The paperwork is with the two outfitters and as soon as they get payment they will hand over the paperwork to the taxidermist, I will get you a letter from them for that. Or he can send an email to National Parks again and see if they can help him what he did in the past.

Rerebuttal from Mitch Cain:

First of all. We did not book a hunt with Ernest Sibanda, but with Out of Africa - Dawie Groenewald.

Second of all, I did cancel my check, because I was advised to by people at a lodge in Victoria Falls and also popular hotel in Johannesburg on my return home. I told Dawie that once my clients had received their trophies that I would gladly send him the $7,900. That he said I owe him. All four of my clients from the US paid Dawie in full, months before we ever went on the safari and any extra trophies that they shot were paid for on the spot before they left. I have sent numerous letters, photos and receipts to National Parks in Zimbabwe, and have talked to some official there, but the country is in such disarray that nothing has been done in two years. I waited two years to report to you because, I was waiting for Dawie to make right. He hasn't, so I sent in the report.

I also had to pay one of the black landowners one day $600 cash in order to hunt, because he hadn't been paid in months and they wouldn't let anyone else hunt unless they got some money. My PH Geffert later got this money back for me from the landowner.

Why would Dawie hold the trophies of the other hunters who have paid him over $100,000 because I owed him $7,900? Headman Sibanda called me last January after the SCI show and said that Dawie still owed him $20,000 for my client's trophies and mine and that we must pay him, before he would release the trophies. Also I have been contacted by Ernest Sibanda several times, wanting the $7,900 for which Dawie said I owe him. Ernest said that Dawie never did pay him the $7,900 that he owes him for trophies already shot. I have also been contacted by some other company over there wanting to collect $2,500 for a buffalo. Why can't the Safari Opeartor (Dawie) not handle this instead of putting the hunters in the middle?

So, you can call Ernest and Headman and see that I tell the truth. Also, the other hunters names and phone numbers I gave you earlier.

My experience with Dawie is he has an answer for everything and it is always the client who is wrong. You will have to decide what is right yourself. I just wanted to file a hunting report about what happened and what is the truth. My other clients were there: Bill and Tom Dejong, Bill Penn and Dena Immon, they can also tell you the truth.

I do not expect to ever get the trophies back, but just wanted it documented.

Letter from Bill Penn:

This letter is being written to confirm the recent letter you received from Mitch Cain regarding the problems our group is having with Out of Africa Adventure Safaris, owned and operated by Dawie Groenewald. We booked a Zimbabwe Safari with Out of Africa at the 2004 SCI show in Reno for August of 2005. We booked a year early to get the current lower daily fees and trophy fees. However, when we met Dawie and his brother at the 2005 SCI show in Reno they attempted to deny our 2004 rates and in spite of deposits sent in 2004 they tried to make us pay the 2005 rates and trophy fees. My personal hunt was a package for leopard, Cape buffalo, and sable for $16,950.00, plus additional animals at 2004 trophy fees. I specifically got verbal agreements from Dawie and his brother Janneman that if I did not shoot one of these three animals they would refund the respective trophy fee.

We began our Zimabwe safari on August 14, 2005 and we were hunting near Hwange National Park at a camp called Malindi. Almost from the start we had major problems. Our lead professional hunter had to drive to Bulawayo the first day to obtain permission to hunt. We had five hunters in our group, and there were five professional hunters but only two trackers. We sensed right away that there were bad feelings between the local blacks and Out of Africa, and in several instances we had to pay money to hunt certain areas or wait hours for permission to hunt certain tracts. Almost all the hunting was done at water holes although we were promised spot and stalk hunting. Food and fuel began to run out very soon, and after 7 or 8 days of our 14 day safari we all decided to follow our PH's advice and finish our hunt in South Africa. While it is true that Dawie was not personally in Zimbabwe on our safari, our PH's were in constant communication with him by phone. In spite of these problems most of our party got Cape buffalo, sable, but no leopard as we were told by the PH's that there were no male leopards in the area.

I went to Limpopo, South Africa to finish my plains game hunt on August 22, 2005. After shooting the desired game I was all set to settle my balance with an assistant of Dawie's. Right off there were problems with the charges Out of Africa was asking for. In spite of our verbal agreement, Dawie refused to credit the trophy fee for the leopard I did not get. This trophy fee was $3,000.00. I had wounded a sable in Zimbabwe and had to shoot another one. They wanted me to pay $5,000.00 for the second one although the trophy fee was $2,500.00. The lower daily rate in South Africa, $350 per day was not adjusted from the $700 per day I paid in Zimbabwe. I was extremely frustrated and spent several hours negotiating with Dawie on the phone. Finally, I went to bed where I was awakened by my PH who said I would be arrested and not be permitted to leave camp unless I paid right then.

After one final phone conversation with Dawie, he agreed to credit the $3,000.00 leopard fee and only charge me the correct $2,500.00 trophy fee for the wounded sable. At that time I paid him in full, $11,000.00 plus the original $16,950.00 and I obtained and have receipts for this payment in full.

In January 2006, at the SCI show in Reno I spoke to Dawie at his booth to find out about our trophies. He assured me that my trophies would be shipped and that there was no problem is spite of his dispute with Mitch Cain who had stopped payment on his check to provide some leverage to eventually get our Zimbabwe trophies shipped. I eventually received all my South Africa trophies in the summer of 2006 but none of the Zimbabwe trophies. In January 2007, I again spoke to Dawie at the SCI show in Reno. He promised me that I would get my Zimbabwe trophies before April 1, 2007, acknowledged that I had paid in full, inspected the receipts I provided him with at the show. In spite of several e-mails, he refuses to do the right thing and pay for my trophies so they can be released and basically has ignored all my attempts to obtain my paid in full Zimbabwe trophies.

Letter from Bill De Jong:

My name is Bill De Jong and I am writing to let you know about a hunting trip that I took with Out of Africa Adventurous Safaris in 2005. Mr. Groenewald's outfitters guided us in Zimbabwe and South Africa. We went on a hunt with his company in August of 2005. I traveled with a group that included my brother Tom De Jong and Mitch Cain. While in Zimbabwe, I shot a warthog, Cape buffalo, and sable. I have not heard from the outfitter in two years and still have not received the trophies for these animals. I understand that a different member of our hunting group has not made payment in full to Dawie, but that should not effect the delivery of my trophies.

After the hunt, Mitch Cain was informed by several other hunters in Africa that we may not receive the trophies from Out of Africa outfitters. He immediately canceled his check because he believed he would not receive his trophies. He is the only member of the hunting group that has not paid in full. He withheld his payment as collateral for our group. Dawie has been informed by Mitch several times that he would pay the rest of his bill once we all receive the remainder of our trophies.

I made payment to Out of Africa Outfitters for all of my trophies prior to even traveling to Africa. The animals that I shot in Zimbabwe I still have not received, but I did receive the trophies that I shot in South Africa. Out of Africa was the only outfitter that guided us while in Africa.

Mitch Cain has let us know that he has been in contact with you already. His account of the hunt and of the payments is true. It seems that Mr. Groenewald has a different account of the situation. The bottom line is: I made payment to Out of Africa Outfitters prior to the hunt and had all business dealings with him.

I would really appreciate any help you could provide with the situation. I enjoy hunting in Africa, but would not return with the Out of Africa Outfitting Company. I still hope to receive the trophies that I made payment for.

Letter from Tom De Jong:

I am writing this letter in regards to our dealings with Mr. Dawie Groenewald with Out of Africa Adventurous Safaris. We went on a hunt with his company in August of 2005. I traveled with a group that included my brother Bill De Jong, Mitch Cain and several other hunters from our area. While in Zimbabwe, I shot a Cape buffalo, sable and baboon and made payment for these trophies in full to Mr. Groenewald. I have given the hunting outfitter over two years to send our trophies and still have not received any of these trophies, nor has any money been refunded. It seems that Mr. Groenewald is claiming that he is withholding my trophies because of non-payment from Mitch Cain, a different member of the hunting group.

Several organizations and people informed Mitch Cain that he should cancel his check because of information they heard about the hunting company. He had also heard of other instances were hunters had not received their trophies from Mr. Dawie Groenewald. As a consequence, he decided to cancel his check and has not paid in full for his trophies. Mitch only held his payment back as collateral for our group to get our trophies. He has stated to Dawie several times that he would pay his bill in full once we all received our trophies.

However, the other members of the hunting group have paid in full and are still awaiting arrival of several of the trophies. I have receipts that prove I have paid $18,950 to Out of Africa outfitters, which I have copies to prove. My brother Bill has also paid in full and not received the trophies that he shot in Zimbabwe. We did receive the trophies that we shot in South Africa, but all the trophies that were shot in Zimbabwe are still being withheld. While we were in Zimbabwe, we were always guided and under the responsibility of Out of Africa outfitters.

We know that Mitch Cain has been in contact with you regarding this situation. The information about the hunt and unreceived trophies that he has provided to you is true. I had already made payment in full prior to the hunt to Out of Africa Adventurous Safaris. As far as the outfitter Ernest Sibanda claiming that we still have an outstanding balance with him that is between Mr. Groenewald and Sibanda.

There is no reason that our trophies should be withheld because of Mitch Cain's non-payment. I just wanted to take the opportunity to let you know about our situation. I have been to Africa before and I would like to go back, but at this time would not recommend Out of Africa outfitters to my friends. I hunted with Tollie's in South Africa and had a great hunt without any problems receiving my trophies.

Additional comment from Dawie of Out of Africa:

I am not a registered hunting operator in Zimbabwe, so I hunt through licensed operators. Give me one reason why they will release the trophies if the one guy didn't pay his trophies, what insurance do they have that Mitch Cain will pay them. They are keeping the trophies because if they send it and Mitch don't pay what insurance will they have. I had a telephone conversation with William Penn also in this group and he talked to Ernest Sibanda the operator that is holding the trophies back and he explained to them the circumstances around the whole situation. If Mitch Cain pays they will get their trophies.

Additional Comment from Mitch Cain:

Ok, So Dawie says that "he is not an operator in Zimbabwe", but now he advertises in the SCI Publications that he indeed is. When we booked over three years ago, we signed contracts with "Out of Africa Safaris" NOT Ernest Sibanda or Headman Sibanda who are Dawies' silent black partners in Zimbabwe. But their names or co. names were not on the contract. So, we didn't know they were partners.

The reason that I canceled the check for 7900.00 written to Geffert Pretorious , Dawie's South African P. H. is because I couldn't get a receipt from Geffert or Dawie or Janneman in about 8 days of trying. With all of the advice from people I came in contact with over there in Zimbabwe(including landowners who I had to pay extra to hunt, because Dawie hadn't paid them) and South Africa oufitters and PHs also, I was nervous about where my check would end up and if I could get credit for it or not. Dawie asked me several times,"Why do you need a receipt?" I also talked to all of Dawie P.H.s that I came into contact with and none of them had been paid either. I was advised by them and hotel owners and lodge owners to cancel the check until I got the trophies. I paid for all of my trophies in S.A. and received them in 6 months as well as all of my client's trophies. I also paid Dawie 10,000.00 dollars for my hunt months before I ever went. My clients also paid in full for their package hunts and paid for all other trophies shot when they were there. I was told by Ernest Sibanda a yr. and a half ago that I owed him 8600.00 for one trophy, and Headman Sibanda has contacted me several times including last yr. one day after the SCI show and says that my group owes him 20,000.00 and he wont release the trophies until he is paid. He said a yr. ago that Dawie is not a partner any more and he owes him much money for many other hunters besides my group. He said that he went to Dawies booth last yr. and took mad clients with him to talk to Dawie and see if they could get payment from Dawie to Headman in order to get their trophies.

Believe me, it's not just my group, its many.

You can believe me or not, I don't really care, I speak the truth. If I pay Ernest Sibanda 8600.00 then there is still Headman Sibanda to pay 20,000 more because Dawie never paid him. There has never been any licenses purchased for any of the trophies we shot and paid for, because the black landowners never received their payment. So, how do we know if there are any available if we do pay more? We don't.

So, you tell me, knowing all that I know, would you pay another dime to Davie in my shoes? I am not stupid and can't afford to throw good money away. So, he can either send all of the trophies and then receive payment from me then. Or he can send my client's trophies to them, who all paid for in full two and a half yrs ago. Or he can answer to their attorney at the SCI show, I don't really care what he does now, because its in legal advisors hands as far as I know. They are all very upset and have promised to show up in Reno with the proper authorities.

It's up to Dawie to make it right, not me. He is the one holding on to trophies paid for, not me.

I should also tell you, that I have been billed for one buffalo from two different black operators over there. Who do I pay, one or both or what. Plus I am told I owe Ernest Sibanda another 8600.00 plus Headman Sibanda another 20.000. Whom neither one of their names were on our original designed contracts. So Dawie sells hunts in his name and co. name in Zimbabwe and then said that he is not an outfitter over there when it is time to cough up the trophies.

Don. Please add it all up, consider it and you make a judgment call. I know what I think.

ADDITIONAL HUNTER COMMENTS AND/OR OUTFITTER/BOOKING AGENT REBUTTAL
Below is a brief summation of the problems and deception that took place during and after our hunt. A limited amount of documentation is listed to support all that is said. Additional documentation is available and will be offered of required for any purpose. Mike and I booked two hunts in January of 04 at the SCI convention with Out of African Adventurous Safaris (OAAS). Mike's booking was for sable and leopard, and my hunt for sable, leopard and buffalo. Both hunts were to take place in Matesti Unit 1, in Zimbabwe with the association of EK Safaris. Additional animals of importance were bushbuck and eland. Completed contracts and deposits were made by March of 04. Remember these dates. Numerous emails were exchanged during the time frame between contract signing and our hunt which was scheduled for May 2005. After our contract signing, the firestorm of South African safari hunting companies doing business in Zimbabwe hit the hunting reports etc. OAAS continued to assure us that our hunt was going as planned and everything was in order.

In March of 2005, Mike and I received a letter from Janneman Groenewald (OAAS) informing us that we needed to pay for our safari in full 60 days before our hunt begins. I did increase my deposit but told them I would not pay in full (trophies etc) until our safari actually commenced which was inline with our original signed contract.

Let's jump forward into the hunt. We arrived in Victoria Falls as planned on May 19th 2005. We were picked up by OAAS PH's Josua Van Straaten and Geffert Pretotius. On the way to Matesti, I was told by casual conversation (with Josua) that there weren't permits for bushbuck or eland. We were not told of this until now. We arrived at camp but it was Unit 5 Matesti, and not Unit 1. Also, we were told that this concession was owned by Nyala Safaris, not EK Safaris Leter, we learned that HHK Safaris also owned the rights to Unit 5. Nyala and HHK split the concession rights to the animals by 50% for each. A quota for four sable would be split among them - two for each company. Both the PH's Josua and Geffert are South Africans and therefore can not legally guide or operate any safari activity in Zimbabwe.

When we arrived, we asked if any leopards were hitting our baits. Geffert informed us that there were no baits hanging. We were told at booking that they would pre-bait for us. We asked if we could go out today and starting shooting and hanging bait. We were told that they didn't have permission to hunt today nor has the Zimbabwe licensed PH's arrived. Already the safari was beginning to smell funny; no legal PH's, wrong Matesti unit and Zimbabwe Safari Company, no pre-bait stand, no permits for eland or bushbuck. We were also told at camp that bait impala was going to cost $150. Out contracted stated that each bait impala would be priced at $50.

The next day, May 20th, we were ready to hunt at daybreak. The OAAS PH's kept us waiting for hours. Finally, they admitted that they didn't have permission to hunt or permit for game from the Zimbabwe Parks and Wildlife Service. We were told that the park service was telling OAAS that they need to pack up and leave! The PH's said that there was a dispute between n Nyala/OAAS vs. the Park and Wildlife Service. They would try to work it out. So far only one licensed Zim PH had arrived. We told OAAS that these problems needed to be worked out quickly. We didn't fly over here to sit in camp all day while they sorted out their problems.

The following day, May 21st, we were told by OAAS PH's that we have permission to hunt bait - but only bait for leopard for now. Everything else needed to be sorted out (later that day, this story changed to that we could hunt sable). We left to hunt bait - all of us in one truck. Ten people crammed into one vehicle. We paid for a one on one hunt - not this. We should have had two vehicles, not one. The reason for one vehicle is that we only had one Zimbabwean licensed PH with us. We did come across a small herd of buffalo Josua and Geffert assessed the herd and we stalked them for several hours. Josua and Geffert selected the buff for me to shoot which I did. The first shot broke both from shoulders of the buffalo dripping him to the ground. Joshua and Geffert immediately shot at the buff. The back-up shot was unwanted and unnecessary. I told them I would empty my gun on it before I ever took a shot. The PH's shooting was not warranted by a safety concern.

When the vehicle arrived with Mike and other staff members, it became apparent that there was a problem with shooting the buffalo. Mike and the only licenses Zim PH had stayed with the vehicle during the stalk. The buffalo was shot several miles from any licensed Zim PH.

After dark that evening, David arrived and is the only other Zimbabwe licensed PH in camp. David works for the Zimbabwe Parks and Wildlife, Mugundumu Safaris Matesti Unit 5. After dinner we discussed out intention to hunt sable, and leopard. David seemed quite bothered by the fact that we each wanted sable. On the morning of May 22nd, David stated that we now have permission to hunt! Does this mean that we didn't have permission yesterday when the buff and some bait were shot?

He also announced that we didn't have permits for hunting sable. None! Throughout the day the deception continued to creep out. The upshot is that there were no permits for sable for quite some time. There were only two sable on quota for Nyala Safaris which were shot several weeks ago with Geffert Pretorius as the PH!. They knew it and they have been hiding this fact for three days. Also, they were taking us to areas in unity 5 that were unlikely to have sable to keep us from coming in contact with a sable. We were hunting in areas better for buffalo and was why we came across the buffalo earlier in the week. Out of Africa Adventurous Safaris in January 2005 knew that there wouldn't be enough permits in Matesti for sable . They over sold the hunt. I pointed out the dates of our contract and the letter asking for additional payments. Clearly, they knew of the problem well before Mike and I flew to Africa! What little hunting we had done up to this point was obviously a sham as far as the sable was concerned. We were told earlier that we were hunting for sable, buff and bait. Clearly, we were not.

Later in the day after Mike and I had a very serious pointed discussion with our PH's and the Zim PH's regarding the situation. We told them we were going to leave if these problems aren't sorted out. We didn't fly over here for a photographic safari or for the bait and switch tactics. By bait and switch, I am referring to the enormous pressure from the minute they picked us up, to the current discussion for us to shoot other animals not on our contract such as zebra,, giraffe, and kudu, etc. It make sense now; keep us busy shooting other stuff so we don't leave upset of the sable, leopard situation. By the way, the "other" animals they wanted us to shoot were at greatly inflated prices from what we were quoted at the time of our booking!

Some time after the heated discussion that day, OAAS and the Zim PH's stated that they would allow us to shoot one sable in Matesti unit 5 and squeeze the books for the permit. I asked, "Does squeezing the books mean fixing them?" They confirmed my suspicion. They quickly took Mike and me to another area of the unit to look for sable. Mike and Geffert spotted a monster sable. Geffert called David to verify permission to shoot it. The permission was denied! Mike was only allowed to videotape the near 50 inch sable! At sundown Josua and I spotted a second sable that was a likely shooter. Josua and I were in a separate vehicle than Mike and separated from him. I was told by Josua that Mike was stalking the sable that he radioed earlier about At this point in time, I didn't know that Mike was denied permission to shoot the sable he spotted. I was told Mike was hunting a sable and might have shot it, and therefore I couldn't go after the one I spotted. That was the final straw - almost. At dinner that evening Mike informed me of the sable and showed the videotape to everyone of the near 5 inch animal. Mike informed me of the denial to shoot it which was not what the OAAS PHs told me. When Mike and I confronted everyone with this obvious conflicting story, David and the OAAS PH's confirmed they denied Mike to shoot it and they didn't want me to shoot one yet either because they didn't have the permit problem sorted out. We told them that this is it! No more deception would be tolerated. They them offered to take us to another hunt area of 6k acres to shoot a sable. They could get one permit for that area/farm. We told them that we each booked a hunt for sable. What about the other permit? They later stated after a heated discussion that we could shoot two and they would come up with another permit later. Mike and I didn't feel comfortable with this situation. It sounded too much like poaching or very close to it. Plus we didn't fly to Zim to hunt 6k acre area box hunt. At this point in the hunt we had some bait hanging for leopard. But let me discuss the problems with it. It has taken four or five days now to hand a few bait animals. Clearly not much time left to hunt now. The bait was ridiculously treated. I have photos of anywhere from six to eight people dragging the bait to the tree. Think of the, six people dragging one impala? Wouldn't that leave more human scent than animal? Yeah right! All of the baits were near the road. You could literally drive the road and see the bait in the tree for most of them. Do you think a leopard would ever come in during shooting hours in that situation?

Now let me point something else out. There were only five leopards on quota for unit 5. The quota would be split between HHK and Nyala Safaris. That would leave two to three for Nyala. If Mike and I shot a leopard each, what would they have left for the remainder of the season? Makes sense now doesn't it. Read on- it gets worse. Very late that evening of May 22nd, we had a frank discussion with David of Zimbabwe Parks and Wildlife (Mugundumn Safaris) concerning the poor treatment and obvious fraud being committed. He felt quite badly about the situation and offered to show us some documentation concerning out hunt. The first document was a memo sating the OAAS is banned from conducting any safari operations in the entire country of Zimbabwe. The second document was the contract between Nyala Safaris and OAAS indicating that they have oversold the hunts for the amounts of permits actually available for sable and leopard! We videotaped and photographed the documents. I retained a copy of the contract between Nyala Safaris and OAAS.

At daybreak on May 23rd, they wanted to move us to another camp to hunt the one sable located 4 1/2 hours away in Gwayi. We would have to abandon the baits for now. How can you hunt leopard and sable in two different camps four to five hours apart one way? Worse yet, they also announced that HHK would be arriving to share the concession and camp in two days. Get this, even if we come back to hunt the leopard, HHK Safaris would be driving the roadways with their clients looking for animals. How can we sit in a blind and have any reasonable chance at a leopard with HHK driving near us and out bait? We were told that HHK was bringing in a party of 12 people and would be using at least three vehicles. My understanding is that the OAAS PH's were aware of HHK's scheduled arrival for quite some time.

That was it. No permits for sable. The leopard hunt was a farce from what I saw. We certainly had zero chance for leopard. We made them take us to town so we could make arrangements to get back to the USA. We had enough of the charade.

While in Victoria Falls, the phone calls were never ending from Dawie Groenewald (of OAAS) and Headman Sibanda (of Nyala Safaris). Headman wanted payment for our safari and Dawie wanted us to agree not to disclose the situation to any authority or the Hunting Report. We demanded our money back. So far, we haven't received anything.

The above nightmarish event is the kind of thing you read about happening to someone else. Unfortunately, it is our nightmare.

Rebuttal 10/11/05

I will try to reply to as many of the substantive allegations as I can. The complaint is a rambling narrative that doesn't lent itself to simple responses. So here it goes.

Compaint - The Hunt was to take place in the Matetsi Unit One: Response: Attached are copies of Mr. Nave's and Mr. Anczak's contracts. There is no specification of Unity One and in face the base camp for his hunt was in an adjacent block, Matetsi Unit Five.

Complaint- No permits for bush buck or eland. Response: There was not quota for bush buck or eland in Unit Five. However, we did have quote for these animals in other concessions a short distance away.

Complaint - No pre-baiting. Response" It was our plan to have leopard baits handing from prior hunters. However, it turned out we had no prior leopard hunters in that area and, therefore, there were no eftoer baits. It is actually against the law to pre-bait an area. However, it is permissible for leftover baits to remain up. Baiting begain immediately and within a matter of three days (about the time Mr. Nave and Mr. Anczak decided to leave) a leopard was on bait.

Complaint - First day we couldn't hunt. Response: They are correct. Because of difficulties in getting the required staff to the camp, they did lose the first day of hunting. Our Safaris in Zimbabwe are operated through Nyala Safaris, a licensed Zimbabwe outfitter. Additionally, die to some paperwork that was apparently lost by National Parks, the owner of Nyala Safaris had to make a trip to their office to re-sign a form, which he did.

Complaint - Told bait animals would cost $150. Response: If they were told that, it was incorrect. Their contract did call for bait animals to be priced at $50 each.

Complaint - only one truck. Response: Correct. The first day of hunting there ws only one vehicle. We only had one Zimbabwean PH in camp, so we were required to use one vehicle, the second PH arrive the next day.

Complaint - Unwarranted back-up shot on a cape buffalo. Response: The PH accompaning the hunters is responsible for the hunter's safety and the safety of the other participants. It is the PH's decision when a back-upshot is warranted on damgerous game. We stand by the PH's decision.

Complaint -Deception concerning sable permits. Response: Mr, Nave points out that it was his intention to hunt sable in Unit Five. HE had already been informaed that we had no quota for sable in that concession and we would have to travel to another concession where we did have quota for the anumals. He continued to insist and demand that he would take a sable in an area where there was no quota. Doing so would violate the law. We did have quota in another nearby concession and continued to talke excellent sable from this concession after Mr. Nave's scheduled hunt. Nothing in this contract indicates that his sable had to come from any particular area. The other concession is over 6,000 acres, unfenced and we have quota for six sable per year there. The animal quality is exceptional, among the very best in Africa.

Mr. Nave repeatedly threatened the PH's and staff if he ws not able to shoot a sable in the Unit for which we had no quota. The situation in camp deteriorated on a rapid basis with Mr. Nave's repeated threats and demands that the PH's and staff break the law.

Complaint - Improper baiting for leopard. Response: Leopard baits were properly set. This is shown by the fact that by the time Mr. Nave and Mr. Anczak left camp in childish fit, a leopard was on bait and subsequent hunters did take leopard in that very area.

Complaint - Out of Africa banned from conducting safari operations in the entire country of Zimbabwe. Response: Out of Africa does not conduct safari operations in Zimbabwe. All of our business in Zimbabwe is conducted through local licensed Zimbabwean outfitters including the Nyala Safaris, just as their hunt was being conducted.

Complaint - Oversold hunts. Response: All animals that were contracted for were available and could have been taken. They elected to terminate their safari early. There were other concessions available to take plenty of animals. They go on to complain that they were pressured to take anumals they did not want, contradicting their claim of being "oversold". They chose the animals they wanted, we had areas they could all be taken in. If staying in one location was more imporatant than taking the animals on their list, then they should have told us.

Complaint - Sharing the safari area with HHK. Response: HHK did not come into this safari area during or after the time they were there. Their "understandings" and speculation have no basis in fact.

Complaint - Request not to disclose the situation with any authority. Response: Mr. Nave used threats of complaints to Safari Club International, The Hunting Report, and Accurate Relaoding as leverage to demand the refund of his money. We attempted to make a financial settlement with them for some time after their return. The neogotiation's broke down after Mr. Nave refused to pay for the buffalo he shot. In conclusion and hindsight, Mr. Nave came to Africa with a chip on his shoulder. He complained about everything from the moment he arrived. We acknowledge there were problems that affected their hunt, none of which would have prevented them from having an outstanding hunt and taking outstanding animals, as our clients did both before and after their scheduled hunt They have repeatedly demanded money from us and we feel their threats were nothing more than an attempted extortion. Sincerely, Janneman Groenewald Out of Africa Safaris

This was my first time to Alberta whitetail hunting. I have been on Bob's waiting list for five years. Bob runs an excellent hunt. The lodge and Shelia's cooking are first class all the way. The guides were friendly and knowledgeable. I was hunting the first week of the season. I shot my deer on 11/10/06 alittle after 1 pm. You are hunting in towers and you must be patient and plan on being in the tower all day. Everyday you noticed a little more rutting activity from the previous day. Just to be hunting in an area wher a huge deer could stop out at anytime was exciting. I plan on returning next year and subsequent years if Bob has room for me.

SERVICE RATINGS (excellent, good, fair or poor)
Quality of Outfit: Excellent Guide/PH Ability: Excellent
Condition of Camp: Excellent Condition of Equipment: Excellent
Quality of Food: Excellent Trophy Care: Excellent
Name of Airline: South African Air Airline Service: Excellent
Airline Comments: International flights are the best as these companies still know the true meaning of customer service. First time I have flown coach internationally, as I took my son, and it will be the last. It is a long plane ride in a small seat for someone 6'2" and 200 pounds.

COSTS
Hunting Fees: Bought hunt at local SCI convention. Took son for additional $1,500. Amount: $0
Trophy Fees: Amount: $0
Permits/Licenses: Amount: $0
Commercial Airfares: Bought one coach ticket at $1,658 and used frequent flyer miles for other. Amount: $0
Charter Airfares: Amount: $0
Other Costs: Amount: $0
Total: $0

SUMMARY REMARKS
Problems of Hunt: No problems whatsoever from airline and outfitter standpoint. The only real problem was getting our rifles registered once we landed as we almost missed our connecting flight. More paperwork than any on my previous trips is now required. Most of it is redundant.
Highlights of Hunt: Taking my 12-year-old son to Africa - both Zimbabwe and South Africa for the time of his life and a great bonding experience. Seeing him shoot the animals on his list and experiencing the hospitality of Africa and the great camp of Out of Africa. Oh yeah, taking the new SCI #1 black wildebeest and many more gold ranking record book animals. I am an SCI measurer but now need a master measurer to confirm the black wildebeest. Actually, my son's 55 inch kudu and 24 inch impala are both larger than mine from previous trips and he reminds my daily.
Equipment Recommendations: Hunt with what you feel comfortable shooting. Terrain ranges from open to very thick. I took a 7mm and .375. My son shot my 7mm. Take your briar pants for the thorns. Briar proof long sleave shirt if you have any good comfortable boots.
Would You Recommend This Hunt to a Friend? Yes
Why? Excellent camp, food, animals, staff, personalities, equipment, concessions, and people in general from the maids all the way to the owners.

ADDITIONAL HUNTER COMMENTS AND/OR OUTFITTER/BOOKING AGENT REBUTTAL
This is my fifth trip to Africa and one of the best. Weather played a major factor early in the hunt, but is something all hunters have to deal with on any hunt. Hunting in the Northern Transvaal is just that, hunting. You are riding around and the stalking. Unlike my experiences in the Cape where you are riding around and picking out what animal you want to shoot. Having said this, your success rate on animals on your list may fall short, as that is part of hunting as well. You may or may not see a shootable animal (very unlikely, but possible) during your stay. We did not experience this problem at all. Out of Africa and Dawie, Janneman and Teressa are professionals to the truest extent. Everything went without a problem from being picked up at the airport on time (my wife went with me on one trip and the outfitter was an hour late. She was scared to death that we were going to be stuck in the Pietersburg, South Africa Airport) to the camps being clean and above average from a comfort standpoint to the food, guides, animals hunted, trackers, skinners, skinning shed, etc.. Out of Africa is definitely where I would take a spouse or family on a hunting trip or if it was just me hunting again. Wheather you are hunting specific animals on an awards list or going to have the time of your life, just hunting and relaxing in Africa, Out of Africa is the place to go.

This was my first bow hunt with Out of Africa. I have been on four previous safaris with other outfitters and their service doesn't even compare. The entire staff and families at Out of Africa bent over backwards to make sure that I had a safe, enjoyable African adventure. Without a doubt, the most professional safari company I have ever had the pleasure hunting with. Craig Coppen is the most experienced bow hunting PH I know. He has a great sense of humor and a wonderful personality. His knowledge of the bush and animals far exceeds his age. Once you hunt with Craig, you will definitely have a friend for life. I am already planning my next bow hunt with Out of Africa Adventurous Safaris.

ADDITIONAL HUNTER COMMENTS AND/OR OUTFITTER/BOOKING AGENT REBUTTAL
The guide was very personable, very experienced and quite knowledgeable. Johan is the type of person I would like working for my company.

The outfitter was very informative. Everything was explained clearly. We have traveled all over the world and we have found Out Of Africa Safaris to be the best.

The money we spent on our African vacation (safari) was very little for all of the service, animals and care that we received.

I look forward to recommending this company to all the SCI members. I also would like to let women know this is the type of holiday (safari) to enjoy with the utmost comfort, service and excellent cooking. We bagged and saw many size trophy animals.
